Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Öztract (“Öztract,” “we,” “us,” or “our”) through oztract.com and any related website, application, software, or services through which Öztract enables users to submit content to third-party artificial intelligence providers and receive generated summaries or other outputs (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You may need to create an account to use some features. You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account.

We may suspend or terminate accounts that violate these Terms or create legal, operational, or security risk.

2. Description of the Services

Öztract provides software and informational tools that allow users to upload, paste, review, organize, and better understand documents and text through AI-powered processing and summary generation features. Some features may use automation or third-party artificial intelligence providers to generate summaries, highlights, classifications, analyses, or other outputs.

The Services may be offered in both free and paid versions, and features may differ by plan.

3. Paid Plans and Billing

Certain features may require payment. If you enroll in a paid subscription:

  • You agree to pay all applicable fees and taxes
  • You authorize recurring charges where your subscription renews automatically
  • You are responsible for keeping billing information current
  • Plan features, pricing, billing periods, and renewal terms will be presented at signup or in your account

Payments are processed by Stripe, a third-party payment processor. Your use of payment functionality may also be subject to Stripe’s terms, privacy practices, and processing requirements.

Unless otherwise stated, paid subscriptions renew automatically until canceled. Fees are generally non-refundable except as required by law or expressly stated by Öztract.

We may change pricing, packaging, or features at any time, but changes to active subscriptions will be communicated as required by applicable law or contract.

4. Permitted Use

Subject to these Terms, Öztract grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for your internal personal or business use.

You may use the Services only in compliance with applicable law and these Terms.

The ‘Unlimited’ subscription tier is offered on a fair use basis. While we do not impose strict hard limits, the service is intended for typical human-scale usage in the ordinary course of personal or business use. Excessive, abnormal, or automated usage that imposes disproportionate technical or financial burdens on the service (for example, continuous high-volume use, large-scale batch processing, or systematic content scraping) may, at our discretion, result in temporary throttling, additional fees, plan migration, or suspension of the account. We will make reasonable efforts to notify you and work with you in good faith before taking any restrictive action.

5. Prohibited Conduct

You may not:

  • Scrape, crawl, harvest, or bulk download data from the Services
  • Reverse engineer, decompile, copy, mirror, or build a competing product using the Services
  • Resell, sublicense, redistribute, or commercially exploit data, outputs, or reports except where expressly authorized in writing
  • Use bots or automation to access the Services without permission
  • Upload malicious code or interfere with platform performance or security
  • Use the Services in violation of the law or the rights of others
  • Misrepresent AI-generated content as verified human analysis from Öztract

6. Data Sources and Accuracy

The Services may rely on user-provided content, public materials, third-party sources, automated systems, and third-party artificial intelligence providers to generate summaries and other outputs. Because these sources and systems may contain errors, omissions, inconsistencies, or outdated information, Öztract does not represent or warrant that any output, response, summary, analysis, or other content generated through the Services is accurate, complete, current, reliable, or fit for any particular purpose.

You are solely responsible for independently reviewing and verifying any information before relying on it, and for obtaining professional advice where appropriate.

7. AI-Generated Content

Öztract uses third-party AI services (for example, OpenAI, Anthropic, Google, Perplexity, and similar providers) to generate summaries and other outputs. Your prompts and content may be sent to those providers so they can process your requests in accordance with their own terms and policies.

Some features of the Services use artificial intelligence to generate summaries, insights, recommendations, labels, classifications, or other content. AI-generated output is probabilistic and may contain errors, omissions, outdated information, incorrect reasoning, bias, or fabricated statements.

AI-generated output is provided for general informational convenience only. It should not be treated as a substitute for human review, legal advice, tax advice, financial advice, investment advice, due diligence, underwriting, appraisal, title review, zoning analysis, or regulatory review.

You assume all risk for reviewing, interpreting, and using AI-generated content. You agree that Öztract is not responsible for losses, claims, liabilities, or damages arising from your reliance on AI-generated summaries or other automated output.

Öztract may modify, remove, regenerate, or restrict AI-powered features at any time, and does not guarantee that AI outputs will be available, consistent, or error-free.

8. No Professional Advice

The Services are provided for informational purposes only and do not constitute legal, tax, accounting, financial, investment, real estate, compliance, or other professional advice.

Any decisions you make based on the Services are made solely at your own risk. Qualified professionals should be consulted before acting on any information provided by the Services, especially for high-stakes or regulated matters.

9. Intellectual Property

The Services, including software, design, branding, visual interfaces, text, graphics, compilations, reports, and platform content, are owned by or licensed to Öztract and protected by intellectual property laws.

Except as expressly allowed, you may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit the Services or any portion of them.

10. User Content

If you upload, submit, store, or generate content through the Services, you retain whatever rights you have in that content, but you grant Öztract a non-exclusive, worldwide, royalty-free license to host, process, reproduce, adapt, and use that content as necessary to operate, maintain, improve, and provide the Services.

You represent that you have all rights necessary to provide such content and that it does not violate any law or third-party right.

11. Third-Party Services and Providers

The Services may rely on or link to third-party services, including Stripe, hosting, analytics, and AI service providers such as OpenAI, Anthropic, Google, Perplexity, and similar providers. Those third parties operate under their own terms and privacy policies. Öztract is not responsible for third-party products or services and makes no warranty regarding their availability, performance, legality, or accuracy.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Öztract disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability.

Without limiting the foregoing, Öztract does not warrant that:

  • the Services will be uninterrupted or error-free,
  • the Services or outputs will be accurate or complete,
  • AI-generated summaries will be correct, safe, or suitable for decision-making, or
  • defects will be corrected.

13. Limitation of Liability

To the fullest extent permitted by law, Öztract and its officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, opportunity, goodwill, data, or expected savings, arising out of or related to the Services.

To the fullest extent permitted by law, Öztract’s total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of: (a) the amount you paid to Öztract in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50), if you only used the free version of the Services.

These limitations apply even if a remedy fails of its essential purpose and even if Öztract was advised of the possibility of such damages.

14. Indemnification

You agree to defend, indemnify, and hold harmless Öztract and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

  • your use of the Services,
  • your reliance on outputs from the Services,
  • your violation of these Terms,
  • your content, or
  • your violation of any law or third-party rights.

15. Suspension and Termination

Öztract may suspend, restrict, or terminate access to all or part of the Services at any time, with or without notice, for any violation of these Terms, for security reasons, to comply with law, or to protect the Services or other users.

You may stop using the Services at any time. Termination does not relieve you of obligations accrued before termination.

16. Changes to the Services

We may change, suspend, or discontinue any aspect of the Services at any time, including features, data sources, AI tools, pricing, integrations, and plan structure.

17. Governing Law

These Terms are governed by the laws of the State of Virginia, without regard to conflict of law rules.

Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Virginia, unless applicable law requires otherwise. You consent to that jurisdiction and venue.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
